Please review these Terms of Use (also referred to as "terms" and "agreement") carefully before using the http://www.inkwellartist.com website and my artwork ("services") created by June Ilda Inkwell ("I", "me" or "my"). This document describes your rights and my rights relating to the provision of the Services as defined below. Your access to and use of the Service is conditioned on your acceptance of and complicance with these Terms. These terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with with these terms or any part of these terms as applied by the date of agreement, you must not use this website or any of my artwork.

Changes to the Terms

I may modify these terms to reflect changes in technology, business, and changes in laws and regulatory systems. If I do so, you will be updated by email to the email address you have provided me with.

Third Party Links and Services

I utilize third party services for purchases and maintaining my website (Square, Paypal, and Weebly) that are not controlled by me.

I have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that I shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

I recommend the installation and use of appropriate defense against malware and viruses. I am not responsible or liable for malware or viruses contracted through the use of my website (https://www.inkwellartist.com) or affiliated third party sites and will accept no liability for any claim, loss, or damage costs and expenses incurred by the use of this website or any other website.

Purchases

If you wish to purchase or use any product or service made available through the Service, you are required to input legal and accurate payment information, and agree that you can access the required money for the product to the best of your knowledge.

I retain the right to raise or change the prices of Commissioned or Negotiated work and store items as I see fit. Commission or Negotiated fees are fixed upon agreement of a final price unless you: (a) request significant changes to the work that exceeds an hour of extra work (b) changes to License type, (c) request specific posting or sharing rules that limit my ability to showcase my work or (d) unless otherwise agreed to in the Order. The lower limits of posted pricing guides and brackets are non-negotiable.

I retain the right to refuse service to any individual or organizations. You may not use purchased items for commercial use without first purchasing a Commercial License from me, and agreeing to the terms of use set for that license. You may not duplicate, post or send to third party any artwork or content without my explicit direct written permission. You may not use any artwork posted to the website for Personal or Commercial purposes without the appropriate License.

Personal License

By purchasing any individual piece of my artwork with a personal license you agree to the following:

The license is nonexclusive and non-transferable, and is granted to exercise all the following rights in all media (including electronic, print, video, audio, and any other technology that is now known or may be developed in the future)

(a) Limited Use: You are allowed to distribute copies of, publicly display the artwork, and other personal uses, but may not sell content with the artwork. You may not sublicence the artwork. Any use that is inconsistent with the limited license will be a violation of the license agreement and subject to copyright law.

(b) Credit. You must fully acknowledge in every copy of the artwork distributed, publicly displayed, my ownership of the artwork.

Commercial License

By purchasing any individual piece of my artwork with a commercial license you agree to the following:

(a) Limited Use: You are allowed to distribute copies of, create derivative works (any work including elements of the artwork), display publicly, or use in any advertising, the artwork. You are allowed to sell upto 50 copies of the artwork before requiring the renewal of the commercial license. You may not sublicence the artwork. Any use that is inconsistent with the limited license will be a violation of the license agreement and subject to copyright law.

(b) Credit. You must fully acknowledge in every copy of the artwork distributed, publicly displayed or used in any advertising, my ownership of the artwork.

Commissioned Artwork

If you wish to purchase a commissioned artwork you must accept and follow the terms laid out under the appropriate license and purchasing.

You retain the right to terminate the service before, but not after completion of the Service, and must pay for work already completed at the time of termination. Commissioned work automatically falls under the Personal License and can not be used for Commercial purposes without first purchasing a Commercial License and discussing with me this License change.

I retain ownership and rights to all artwork and intellectual property I create and sell. I do not imply ownership of characters or location imagery of commissioned works beyond my own direct contributions in design. I retain the right to post my work to third party websites and utilize works for portfolios and other uses as I see fit.
